MARSHALL COUNTY, OK -- A man sentenced to life in prison who had filed a motion to withdraw his plea of no contest decided not to withdraw that plea Wednesday.
Joshua Scott is charged with killing Chad Page, Ashleigh Lindsey and her unborn baby in 2012.
He was sentenced to life in prison in December and the Marshall County Court Clerk's office says he filed a motion to withdraw his plea of no contest. That would allow him to receive a jury trial where if convicted he could face the death penalty.

At a hearing Wednesday, Scott decided not to withdraw his plea.

The Marshall County Court Clerk's office says Scott's life sentence stands.

UPDATE [Jan. 2, 2014] -- A court date has been set for a Marshall County man accused of triple murder.
A judge sentenced Joshua Scott to three consecutive life sentences in December.
Scott entered a blind plea of "no contest" in October after agreeing to a plea deal with the state.
Late last month, Scott filed a motion to revoke his blind plea claiming he did not receive adequate legal representation.
His attorney has now asked to be removed from the case.
A hearing is set for January 15.

MARSHALL COUNTY, OK -- A man who was sentenced to life in prison, earlier this month, has filed a motion to withdraw his blind plea saying his attorney was not effective.
Joshua Scott is charged with killing Chad Page, Ashleigh Lindsey, and her unborn child in July of 2012.
Scott reached a deal with prosecutors and entered a blind plea of no contest.
Scott was sentenced on December 11th, but Thursday filed a motion to pull his blind plea.
A court document signed by Scott says quote, "the defendant will show that the defendant received ineffective assistance of council."
Thursday, Scotts attorney Eric Jones filed a motion to withdraw as Scott's counsel.

 Ashleigh Lindsey's mom says she hopes her family will not have to go through the entire process again but that they have to they will." It seems like the nightmare that never ends. But if we have to go back through this as a family my family is strong enough that we will see it through for Ashleigh and her baby."
The District Attorney's Office as before Scott's request to withdraw plea could be granted the judge would have to go to hearing and listen the evidence got attorney Aaron John has also filed a motion asking to withdraw.

Man charged with three counts of murder in Marshall Co. tells his side of the story in letter to the judge...KXII>>Dec. 23, 2013

L COUNTY, OK -- Johsua Scott is charged with killing Chad Page, Ashleigh Lindsey and her unborn baby in July of 2012. He was sentenced on December 11th to life in prison, but filed a motion to pull his blind plea of "no contest" last week. In a letter to the judge, before his sentencing, he describes in his own words the events leading up to the killings. However, Lindsey's mother says a lot of what Scott claims is false.
In a 16 page letter, written to Judge Wallace Coppage, Scott describes in detail the events he claims led up to the deaths of Chad Page, Ashleigh Lindsey and her unborn baby.
In the document, Scott writes that he and his mother's "ex-boyfriend", Chad Page, drove to Fobb Bottom to talk about the couple's relationship. Scott claims the conversation got heated and he says he was "terrified for (his) life" after seeing Page had a knife. Scott says he took a gun from his pocket and shot Page and during a struggle shot him again. Then he writes, "I one hundred percent regret what I did next. Sir, I then proceeded to pull the trigger a third time to end his misery".
"It came out in court that he shot him four times and it came out in court that the pocket knife that he claimed he was threatened or scared by was folded up in Chad's pocket," Woodlee said.
Ashleigh Lindsey's mother Tara Woodlee says Scott's account does not match the evidence.
"He shot Chad in the eye and in the mouth the last two final shots and Chad could have survived the other shots. So I don't see how that was helping him put him out of his misery. I think it was cold and calculated," Woodlee said.
According to Scott, after he killed Page, he called his best friend Joshua Mahaffey -- Lindsey's ex-boyfriend. Scott says Mahaffey told him to drag the body off and to come get him in Texas.
"If he would have not called Mahaffey. If he would have just, you know, taken responsibility for what happened with Chad, or whatever, then Ashleigh wouldn't be dead today," Woodlee said.
The next day, Scott says he took Mahaffey to a home in Enos, where Lindsey was staying. Scott claims he "in no way had any way or Idea of what was going to happen", but Lindsey's mother does not buy it.
"I think they planned it. They had been stalking her for a month and a half, the two of them," Woodlee said.
Investigators say Mahaffey shot Lindsey with the gun given to him by Scott. Then Mahaffey killed himself.
In the letter, Scott says "Ashliegh was like a sister to me", but Woodlee says if Scott were a friend he would never have let her get hurt.
"He watched her be raped, and not do anything, you know the list is horrifying of the things he watched. So I don't understand how he figured that when he took Mahaffey over there that Mahaffey wasn't going to do anything physically violent to her," Woodlee said.
Toward the end of the letter Scott writes to the judge "Sir, I want to let you know that I am full of remorse and am very sorry for what happened."
We have yet to hear back about a hearing date to consider Scott's request to withdraw his plea.

Judge Coppedge sentenced Scott to the maximum sentence allowable... KTEN>>>             Dec, 11. 2013

UPDATE [Dec. 11, 2013] -- The man accused of murdering three people last summer will pay with his freedom.
Wednesday afternoon, Judge Coppedge sentenced Joshua Scott to life in prison without the possibility of parole for all three murder counts. The sentences will run consecutively.
In October, Scott agreed to a plea deal with the State of Oklahoma.
He changed his plea from "not guilty" to "no contest."
In exchange, the death penalty during his sentencing was off limits.
During the sentencing hearing, the mother of one of the victims, Ashleigh Lindsey, wept on the stand while reading a victim impact statement.
It was the first time Tara Woodlee had the chance to speak to Scott since her daughter's murder.
Scott was charged with killing Chad Page, his mother's boyfriend on July 12, 2012.
He was also present a day later when his friend, Joshua Mahaffey, shot and killed Mahaffey's girlfriend, Ashleigh Lindsey. Lindsey was pregnant and her unborn child did not survive.
Mahaffey then killed himself, leaving Scott to face charges.
After today's hearing, Woodlee says she was pleased with the outcome.
"It's complicated because it's kind of a sense of relief," Woodlee said. "I got to say everything I wanted to say but at the same time it's not total justice because what is total justice when you lose a child?"
After hearing multiple, emotional victim impact statements from the families of Lindsey and Page, Judge Coppedge sentenced Scott to the maximum sentence allowable.

 A man who pleaded guilty to murder earlier this year will spend the rest of his life in prison.
That's the sentence a Marshall County judge handed down to Joshua Scott Wednesday.
Friends and relatives of Joshua Scott, as well as families of murder victims, Chad page, Ashleigh Lindsey, and her unborn baby, filled the Marshall County courthouse Wednesday afternoon.
"It was a moment that I needed. I needed to be able to look him in the face and tell him how I felt about everything he had done. Not only to Ashleigh but to our family." said Ashleigh's mother, Tara Woodlee.
After hours of witness testimony, including that of Woodlee, the judge sentenced Joshua Scott to life in prison without the possibility of parole
"Mostly I was able to say my peace and look him in the face and let him know um I was not afraid I was there to be sure that he would never harm anyone again.", said Woodlee.
In October, Scott entered a plea of no contest to three first degree murder charges.
Prosecutors claimed in July of 2012 Scott killed Chad Page, stole his car, then drove Joshua Mahaffey to a home in Kingston where Scott's ex-girlfriend, Ashleigh Lindsey, was staying.
They say Scott gave Mahaffey the gun Mahaffey used to kill Lindsey, and himself.
Defense Attorney Eric Jones says while he was pleased to get the death penalty off the table he understands the impact this tragedy has on so many people.
Jones said, "The thing that was disturbing was to listen to all the victim's impact statements. You realize how horrible all of this really was."
Woodlee says with today's sentencing she can finally turn her full focus to helping other domestic violence victims, like her daughter, with what she has named "Ashleigh's patience project.
"For me it will be a way to extend out hope and love to other women and Ashleigh's legacy carries on in that manner." said Woodlee.

Wednesday morning, Joshua Scott entered a plea of "no contest" to three first degree murder charges. The 21-year-old is charged with killing Chad Page, Ashleigh Lindsey, and her unborn baby in July of 2012.
"I'm feeling really disappointed and a little angry."
Tara Woodlee is Lindsey's mother.
She says she was expecting to finally hear Scott say the word "guilty" today, but that's not what happened.
"It was shaking to hear," Woodlee said.
District Attorney, Craig Ladd, says Scott now faces life in prison without parole.
"I'm hoping that his plea as no contest today will allow us to go ahead and move forward obviously to the sentencing so I feel good about that and at the sentencing hearing, the family will be allowed to be heard."
Scott's defense attorney, Eric Jones, says he's pleased with today's outcome.
"I got the death penalty off the table and he has a chance to argue for a more lenient sentence."
Jones claims Scott was being influenced by Joshua Mahaffey, Ashleigh Lindsey's ex-boyfriend.
"He was basically under his influence to some degree. Although he is still responsible for what happened. there's no doubt about that," said Jones.
Authorities say Scott killed Chad Page, stole his car, then drove Joshua Mahaffey to Lindsey's Kingston home and gave him the gun Mahaffey then used to kill Lindsey, and himself.
"The rest of my life I will be grieving for my daughter. There will be no end."
Woodlee says although nothing can ease the pain of the loss of her daughter and unborn grandchild, Scott's rightful sentencing will help the grieving process...
"She deserves justice."

UPDATE [Oct. 30, 2013] -- Today, Joshua Scott pleaded no contest to three counts of first degree murder, a move family members of the victims say they did not expect.
Joshua Scott said nothing as he was escorted out of the Marshall County courthouse Wednesday.
He had just changed his "not guilty" plea to "no contest," in front of a half-packed courtroom.
Although cameras were not allowed inside, friends and family of Ashleigh Lindsey and Chad Page watched as the man accused of killing them faced a judge.
"He kept smirking and laughing and that was hard to watch," Lindsey's mother Tara Woodlee said.
In July 2012, prosecutors say Scott shot and killed Chad Page, his mother's boyfriend at the time, because he didn't like him, and "thought he was a punk," according to prosecutors.
Later the same day, Scott and a friend, Joshua Mahaffey, went to Heather Lara's home in Enos, Oklahoma, where Ashleigh Lindsey was staying.
"She was staying at my house because we were trying to protect her," Lara said.
Prosecutors say Scott held Lara down while Mahaffey shot and killed Lindsey, his ex-girlfriend with whom he'd had a history of domestic violence against. "He held me would not let me go to dial 9-1-1," Lara said.
Lindsey did not survive. Neither did her unborn child.
In an interview with KTEN earlier this year, Woodlee showed us a photo of a revolver posted to Facebook that she says was used to shoot both Lindsey and Page. PMahaffey also turned the gun on himself, leaving Scott to face three murder charges.
Family members of the victims say they first learned Scott was willing to agree to a plea deal last week in a meeting with prosecutors. They expected him to plead guilty but say they were shocked when they learned in court Wednesday that decision had changed.
"It would have been a sense of, he was actually taking responsibility for the things he had done," Woodlee said.
Under the plea deal, the death penalty has been taken off the table as a possible sentence. A burglary charge has been dropped as well.
Scott's attorney, Eric Jones, says legally, a "no contest" plea is about the same as pleading "guilty," but was an admission he says his client was not willing to make.
"It's very hard to plead guilty to murders," Jones said. "Sometimes it's hard for people who commit burglary to commit to it. It's just hard to do."

Victims' impact statements will be read, and Scott's attorney says Scott will likely take the stand in hopes of receiving a lesser sentence.

UPDATE [July 31, 2013] -- A judge in Oklahoma has upheld a state law classifying the killing of an unborn child as murder. 
In July, an attorney for Joshua Scott appealed a decision by a lower court to charge 

Scott with murder in the death of an unborn child.
An appeals court denied that request, according to court documents filed on July 26. 
Scott is charged with killing Ashleigh Lindsey in July 2012. She was pregnant at the time and her child did not survive. 
Scott's trial date was originally set for late August but it has been postponed.

 three people last summer will be rescheduled.
Joshua Scott appeared in court with his attorney Wednesday
 morning making a motion to continue his trial.
Scott is charged with killing Chad Page, Ashleigh Lindsey and her unborn baby.
Scott's attorney has appealed the murder charge of the unborn child in the 
criminal court of appeals and won't know how to proceed
 until the appeals court rules on that charge.
The trial was originally set for September 30th.

UPDATE [July 16, 2013] -- A man charged in connection with the death of an
 unborn child  in Marshall County is challenging a state law that allows the charges to be filed.
Joshua Scott is accused of helping a friend who police say murdered 
Ashleigh Lindsay in Kingston last July.   
She was pregnant at the time and her unborn child didn't survive.
Scott was charged with the murder of Lindsey and her  baby, 
but earlier this month Scott's attorney filed an appeal 
challenging the murder charge for the unborn child    
Scott's trial is set for next month, but it could be delayed if a
 judge isn't able to make a decision on the appeal in time.

MARSHALL CO. - A Marshall County man charged with first degree murder has pleaded not guilty.
Joshua Scott appeared in court this morning for his formal arraignment. The judge decided the case would go to trial on August 26th.
Deputies say in July, Scott confessed to killing Chad Page and stealing his car.
They say he took his friend "Joshua Mahaffey" to Ashleigh Lindsey's home where Mahaffey shot and killed Lindsey, her unborn baby and himself.
Lindsey's mother says she wants to see Scott punished for his role in her daughter's death.
Tara Woodlee , Lindsey's mother, said "I just have a lot of faith in God that he will provide justice for my daughter. And I want to see justice done for her and her baby."
The district attorneys office has announced that it will seek the death penalty for Scott.   
Deputies say on July 13 Scott shot and killed Chad Page stole his car then picked up his friend Joshua Mahaffey and drove to Mahaffey's ex-girlfriend Ashleigh Lindsey's home.
 There they say Mahaffey killed Lindsey and her unborn baby himself. They say Scott gave Mahaffey the used in the crimes. 
The state says Scott faces three counts of first-degree murder for which they will seek capital punishment if he's convicted. 
"It's called a bill particulars,a document was filed in this case with exactly why we believe the death penalty is appropriate in this case." Craig Ladd DA. 
 The bill of particulars was filed this past Friday and sites two reasons for seeking the ultimate punishment.
Prosecutors said that Scott created great risk of death two were the one person and  the possibility of Scott being a future threat to society.
  Woodlee says this is the first step toward justice for the victims.

MARSHALL CO., OK-An Oklahoma District Attorney said the state will pursue the death penalty if a Marshall County man accused of killing three people is convicted.
Twenty-two-year-old Joshua Scott is due in district court Wednesday morning for formal arraignment. He's charged with first degree murder.
Deputies said, last summer, Scott confessed to killing Chad Page and stealing his car before picking up Joshua Mahaffey and breaking into 20-year-old Ashleigh Lindsey's home in Kingston. Deputies said Scott gave Mahaffey the gun, who then shot Lindsey then killed himself. Lindsey, who was pregnant, later died.
Tuesday, D.A. Craig Ladd told us his office will pursue capital punishment if they get a conviction.

DA Pursues Capital Murder Charge

MADILL ...Emanda Mahaffey entered a plea of no contest to the felony charge of harboring a fugitive in District Court Tuesday. Mahaffey, the mother of Josh Mahaffey, was sentenced to a five-year deferred sentence, $2,500 fine, 100 hours of community service and two years of supervised probation.
Mahaffey was charged after providing support for her son while knowing he was a fugitive. On July 13, Josh Mahaffey killed his estranged girlfriend Ashleigh Lindsey and her unborn child and also killed himself with the same gun. At that time, a warrant was out on Mahaffey for domestic abuse, assault and battery. Lindsey also had a protective order against him.
District Attorney Craig Ladd noted that law enforcement officials had contacted Emanda Mahaffey in efforts to locate him. On July 13, she was contacted by Joshua and met him at a convenience store at about 11 a.m. and paid for his gas and gave him a small amount of money. At that time, he told her he was going to pursue work opportunities in Galveston, Texas. Three hours later, he killed the victims as well as himself.
Prior to Tuesday's sentencing, an offer was made by the district attorney's office for a 1-year deferred sentence with supervised probation.
"I learned that the offer was made without consulting the victim's mother, which is atypical in a case of this nature," Ladd said. "Yesterday, Emanda Mahaffey entered a plea of no contest to the charge of harboring a fugitive. I stood by the offer previously extended to the defendant by our office as a withdrawal of the same would have been improper."
Ladd said he believed Tara Woodlee; Lindsey's mother, had an absolute right to be heard at the hearing. Heather Lara was also allowed to speak. Lara also spoke during Joshua Scott's preliminary hearing Nov. 30.
"Judge (Greg) Johnson graciously allowed Heather Lara, the owner of the home Josh Mahaffey forced his way into moments before cornering Ashleigh in a bathroom and killing her, to make a statement as well," Ladd said.
Ladd said that following the testimony, Johnson refused to accept the deal, which had been brokered and modified the punishment in a stricter form.
"In my opinion, Judge Johnson's handling of the matter is commendable," Ladd said.

MARSHALL CO., OK-A trial date has been set for a Marshall county man accused of murder in Friday morning's preliminary hearing.

Marshall County District Attorney, Craig Ladd, said Joshua Scott is scheduled for arraignment on January 2nd. Ladd said Scott faces three counts of first degree murder for the death of Chad Page, Ashleigh Lindsey and her unborn child. He is also facing charges on harboring a fugitive, larceny of a vehicle and conspiracy to commit burglary.

Scott is accused of murdering Chad Page in July and stealing his car, then giving the gun to Joshua Mahaffey. Mahaffey then shot and killed his pregnant ex-girlfriend Ashleigh Lindsey before killing himself.

MARSHALL CO., OK-More charges have been filed against a man accused in the shooting of a Marshall county woman almost a month ago.
Joshua Scott now faces two counts of "first degree murder" and "conspiracy to commit first degree murder" in the deaths of 20-year-old Ashleigh Lindsey and her unborn child.
He is also facing burglary charges. 
Investigators said Scott and his roommate, Joshua Mahaffey, broke into Lindsey's Kingston home July 13th. Authorities said Mahaffey shot Lindsey, then killed himself.
Scott is held in the Marshall county jail without bond.
His preliminary hearing is set for November.

MADILL, OK-The mother of a Marshall county man who authorities said murdered his pregnant girlfriend, then killed himself, is also facing criminal charges. Emanda Mahaffey was arrested for harboring a fugitive from justice. Marshall County Undersheriff Donny Raley said she intentionally hid her son, Joshua Mahaffey, from law enforcement. Raley said Joshua Mahaffey and a friend, Joshua Scott, broke into Ashleigh Lindsey's Kingston home two weeks ago. Mahaffey shot her, then himself.
Emanda Mahaffey has been released on $15,000 bond.

Kingston shooting victim was boyfriend of killer's mom...KXII>>July 21, 2012

We are learning more about the first victim in a Marshall county double murder, one week ago. 43 year old Chad Page was killed after authorities say Joshua Scott convinced him to take a drive.

Page was Scott's mother's boyfriend and the two reportedly had a rocky relationship. Scott drove to Fobb Bottom Road, where Marshall county deputies said he shot and killed Page then stole his car.

Investigators said Scott then drove to pick up his friend Joshua Mahaffey and the two went to Kingston where Mahaffey shot his pregnant ex-girlfriend, Ashleigh Lindsey then himself.

Lindsey died later that evening. Scott is now facing several charges including first degree murder and could face the death penalty if found guilty.

MARSHALL COUNTY, OK -- Two men commit two separate murders. Now one of the suspects is dead and authorities say the other has confessed. We brought you the story on First News Weekend at 6. 
Amanda Brown spoke with Marshall County law enforcement and brings us the newest details.

Investigators say Joshua Mahaffey and Joshua Scott broke into 20-year-old Ashleigh Marie Lindsey's home in the 13000 block of Cardinal Ln. in Kingston around 2 p.m. Friday afternoon.

"It looks like one of the individuals entered though the back door the same time the other entered through the front I believe Mr. Mahaffey was armed at the time the individuals went inside and resulted in Ms. Lindsey being shot killed and Mr. Mahaffy shooting himself," Jones said.

Lindsey was four months pregnant. Marshall county Sheriff's deputies arrested 21-year-old Joshua Scott in connection with Lindsey's murder then they say he admitted to killing another Marshall County man, 43-year-old Chad Page, earlier that same day hiding his body at Fobb Bottom Rd.

Scott told deputies he stole Page's car before picking up Mahaffey and breaking into Lindsey's home.Scott faces charges for both murders.

"First case is for murder of Mr. page which first degree murder charges will be filed in addition to stolen vehicle charges. Second case first degree murder charges will be filed for Ms. Lindsey's death and felony murder charges for the death of Mr. Mahaffey," Jones said.
